You can hear the "Click" on his revolver right before the "Holy SHIT!". That's the hammer hitting a round that had already been spent. Had he not spent that round, the cop would be dead.
I've been reading up on this, the driver was hit in the back, crashed into a telephone pole and died right there and then.
